Terms & Conditions

I get it, terms and conditions are really boring. But, they exist to provide a clear outline of the agreement between you and I when it comes to booking me to perform at your event. Which is why I’ve laid them out on this page as clearly and as concisely as possible, without the excessive use of legal jargon or mind-boggling lawyer language. DEPOSIT

A deposit of 20% of your total booking fee is required in order to secure your booking (excluding events that are held outside of the UK, see below for international bookings). This should be paid via bank transfer to the details below:

The deposit you pay to secure your booking is non-refundable, as it serves to cover the admin work I put in prior to attending your event as well as security for potential loss of work due in the event of a cancellation. There are some exceptional circumstances where your deposit can be refunded, which are outlined in the ‘Cancellations, Refunds and Charges’ section.

FULL PAYMENT AND EXPENSES

Full payment will be required at least 4 weeks before the day of your event, for which I will send you an invoice prior to the event with plenty of notice. You will find my bank details listed at the bottom of the invoice for BACS transfers. The reference for the bank transfer will be the invoice number.

Travel expenses are additional to the service prices stated on the website. I calculate travel expenses at 45p per mile, however, simplified fees are typically provided to offer a rounded quote price. Accommodation expenses will also be factored in to the total fee if necessary and I’ll itemise all the costs in your quote before you decide whether or not to confirm the booking.

International Bookings

For events conducted outside of the UK, you will be required to cover the following expenses if they are applicable - fuel, flights, accommodation, parking, vehicle hire, airport transfers, international work/travel documents, sound system hire and food and drink expenses for the agreed duration of my visit. It sounds like a lot, but I will always go well out of my way to find the most reasonable and affordable prices. I will itemise these expenses in your initial quote as rough over-estimates and I guarantee to refund you the difference if the actual costs of the expenses turn out to be less than my estimates. I’ll retain all the receipts and you can request to see them at any time, it’s also worth noting that these expenses will be liable to fluctuation in actual cost over time, however I will always try to book everything as early as possible to avoid this. If the actual costs turn out to be higher than my estimates, you will be required to make up the difference in cost. I do reserve the right to terminate the booking if the expenses are not fully covered.

Due to the high costs involved with transporting a sound system via air travel, it is often much more cost effective to hire a sound system in the country the event is being held in. I always recommend checking with your event co-ordinator / venue first, as they will usually have their own sound system or may have agreements with local companies who can provide sound systems for events, the venue may even cover the cost for you if it is included in your hire package. I am happy to liase with your venue / external suppliers in regards to sound system hire on your behalf even if you have not yet confirmed a booking, or I can provide you with a tech spec if you would prefer to organise this yourself.


CONTRACTS

Performance contracts are written up for every booking I confirm, you will most likely receive this as an email link via Signeasy during the booking process. Contracts are necessary to ensure that we both have a fair and formal agreement in writing and have all bases covered prior to the event. The contract will detail our personal and contact details, the venue’s name and address, date of the event, approximate performance times, optional extras and the total fee agreed, as well as the terms and conditions of the agreement. You will need to sign, print your name and date the contract upon receiving it, which can be done using any smartphone, tablet or device, you will then receive a copy of the signed contract to retain for your records. If a contract is not completed and returned, even if a deposit has been paid, I reserve the right to cancel the booking at any time, albeit as an absolute last resort. Contracts may not be modified or cancelled except by mutual consent, in writing signed by both of us. Upon the signing of a contract, you state that all information provided by you is accurate and true to your knowledge.


VENUE, ACCESS AND LOCATION

Upon agreeing to a booking, you warrant that the venue will be of sufficient size for me to safely conduct a performance, that the venue is of stable construction and sufficiently protected from weather and that there will be adequate security and / or emergency medical responders available if necessary. It is your responsibility to ensure that you have provided the correct name, address, postcode and contact information for the venue. I cannot be held responsible for delays resulting from incorrect or inaccurate address details. It is also a requirement that the venue allows reasonable access for suppliers to load and unload equipment and suitable parking once the equipment has been unloaded. If parking for loading is restricted I will not be held liable for any delays or lateness in performance / set times.


SET-UP OF EQUIPMENT

On the day of the event, I will arrive to set up my equipment approximately 90 minutes before the hire period is due to commence.

It is your responsibility to ensure that the event co-ordinator / venue owners have agreed to me being in attendance at their venue and at the agreed time. This also includes ensuring that there is access to enter the venue and a performance space that is large enough with at least 1 power socket within 15 meters of where the services are to be carried out (unless you have requested the battery powered sound system). If there is insufficient space for me to set up and perform you will still be charged the full hire amount.

It is your responsibility to inform me of any circumstances that may make the setting up of equipment take longer than usual, these may include but are not limited to; restricted access to the venue, the venue being located upstairs, a long distance from the loading area to the set-up area etc. If I have not been made aware of any of these circumstances prior to the event, the setting up of equipment will most likely intrude into the hire period with no liability on my part.


HIRE PERIOD

The hire period will be for a set period of time as specified in the booking details and as agreed by both parties during the booking process. In addition this will exclude the 90-minute setup time and 45-minute pack down time (approx). The performance will commence at the agreed time and finish at the agreed time stated in the contract. If there are delays for which I am directly responsible for, I will do my best to provide the service for the set period once the situation has been rectified.

If your event starts late or runs late, which understandably is a common occurrence and is often unavoidable, it will be down to my discretion whether or not to delay the period of hire. I will always try to be flexible and accommodating when it comes to ensuring the services I’m providing run smoothly, but in the case of having multiple bookings or engagements on the day of your event this may not always be possible.


NO LIABILITY IS ACCEPTED FOR:

Loss of or damage to property belonging to/or travelling with the attendees of your event. For example personal belongings, equipment, devices etc.

Personal injury to any participants by my equipment however caused, unless I am to be proven negligent.


TERMINATION OF HIRE

It obviously goes without saying, but I’ll say it anyway, I will not tolerate any abuse or threatening behaviour towards me or other musicians who work with me. If this occurs, I retain the right to terminate the hire, with no refund payable for hire time that has been cut short. Abusive or threatening behaviour should not be tolerated by anyone under any circumstances.

I also retain the right to terminate a hire if I believe that my equipment or property is in danger of being damaged or has been damaged due to behaviour or actions from an attendee of your event. In any instances where I feel there is a need to terminate the hire I will attempt to speak with you or the hosting venue first, if possible to try to resolve the matter before termination.

My equipment and instruments are not available for use by any other person, unless I give permission to use it. You will be held fully responsible for any damages caused by you or any other attendees at your event to my equipment howsoever caused, with the sole exclusion of causing damage myself.

In the event of any damage being caused by attendees of your event to my property or equipment, you will be charged the full replacement cost of the damaged equipment and will be liable to cover any costs involved in me having to hire replacement equipment for future events or the termination of future events.

Any damages must be reported to me immediately.


CANCELLATIONS, REFUNDS AND CHARGES

All cancellations must be made by contacting me via telephone on 07464930825 or by email info@matthewturner.uk. Once your event has been cancelled, the event date will immediately be made available for other people to book. Cancellation may be made by you before thirty days prior to the day of the event, in which case the 20% Deposit is non-refundable, but you will not have to pay the remaining fee. If the event is cancelled within 30 days of the start time, you will be liable to pay the full hire fee agreed for the event (NOT in the case of COVID related cancellations).

If I am unable to perform at your event, the fee will be refunded to you in its entirety (excluding cases of force majeure - an event, situation or circumstance that is out of the control of both parties). I will also do my best to attempt to source a replacement musician for your event, deemed as a similar standard to myself by me, however I cannot guarantee this.

In the case that your event has to be postponed due to COVID-19, your booking can be rearranged to a new available date at no extra cost. Please check with me for availability before you confirm a new date for your event. If I am unavailable on your newly scheduled date, the 20% deposit will not be refunded but no other portion of the fee will be due. If you have already paid in full, you will be entitled to an 80% refund.


FORCE MAJEURE / EVENTS BEYOND OUR CONTROL

I cannot be held responsible for any circumstances out of both of our control that may prevent me from attending your event; these may include but are not limited to, severe weather conditions, traffic delays, vehicle breakdowns, equipment failure, intervention from venue, or government authority etc. In the event of force majeure, the 20% deposit is non-refundable, but no other portion of the fee will be due, and you may negotiate a substitute event on the same terms as the original agreement, with no further deposit due. In which case a new contract will be written up reflecting this and will be signed by both of us. No further damages may be sought for failure to perform due to cases of force majeure. In the case that I cannot attend or fulfil your hire due to force majeure, you will be contacted by myself or the venue as soon as possible - Most venues will have either a resident DJ or other recommended suppliers that can be called upon in these circumstances. In these instances, my liability will only be limited to refunding 80% of the agreed fee.


PUBLIC LIABILITY AND PAT CERTIFICATES

My Public Liability Insurance covers claims of up to £10 Million in any one claim and is provided by Aviva, through Hencilla Canworth acting as brokers for the Musicians’ Union. The cover is worldwide - Effective from 10/07/2023 until 09/07/2024. A copy of the certificate can be produced upon request. My Public Liability Insurance renews on an annual basis.

Professional sound and lighting equipment is PAT tested by Seaward Electronic Ltd - Effective from 01/06/2023 until 31/05/2024. A copy of the certificate can be produced upon request. PAT certificates are renewed on an annual basis.

This sites compliance with the above legislation, all of which are stringent in nature, means that this site is likely compliant with the data protection and user privacy legislation set out by many other countries and territories as well. 3. PERSONAL INFORMATION THAT THIS WEBSITE COLLECTS AND WHY IT IS COLLECTED

This website collects and uses personal information for the following reasons:

3.1 SITE VISITATION TRACKING

Like most websites, this site uses Google Analytics (GA) to track user interaction. I use this data to determine the number of people using my site, to better understand how they find and use my website and to see their journey through the website.

Although GA records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to me. GA also records your computer’s IP address which could be used to personally identify you but Google does not grant me access to this.

GA makes use of cookies, details of which can be found on Google’s developer guides.

Disabling cookies on your internet browser will stop GA from tracking any part of your visit to pages within this website.

In addition to Google Analytics, this website may collect information (already held in the public domain) attributed to the IP address of the computer or device that is being used to access it.

3.2 CONTACT FORMS AND EMAIL LINKS

Should you choose to contact me using the contact form on my contact page, none of the data that you supply will be stored by this website, instead the data will be automatically emailed to me and held in my Google Workspace account.

If you are under 16 years of age you MUST obtain parental consent before supplying any personal information via this website.

4. SECURITY AND  DATA BREACHES

The security of your Personal Information is important to me, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While I strive to use commercially acceptable means to protect your Personal Information, I cannot guarantee its absolute security. Should there be any breach of your personal data, you will be informed within 72 hours of me knowing of it.

5. CHANGES TO MY PRIVACY POLICY

This privacy policy may change from time to time in-line with legislation or industry developments. I will not explicitly inform clients or website users of these changes. Instead, I recommend that you check this page occasionally for any policy changes. Specific policy changes and updates are mentioned in the change log below.
